Dashcams are useful, but they only show what is happening in front of the vehicle. Add a bulkhead and a full load and it gets worse. There is no set fleet size where a CCTV system becomes necessary. On many systems recording continues after the ignition is off, which can record incidents while the van is parked. Under the <a href=\"https:\/\/www.legislation.gov.uk\/uksi\/1986\/1078\/contents\" target=\"_blank\" rel=\"noopener\">Road Vehicles (Construction and Use) Regulations 1986<\/a> a driver must not be able to see a screen while driving unless it shows vehicle status, location, or a view helping them see the road. They do not stop it happening. A camera only helps if the driver happens to be looking at the monitor. Sensors do not rely on that.<\/p>\n<p>Proximity sensors, reversing sensors and turn alarms all work on the same principle, getting the driver&#8217;s attention before contact rather than documenting it afterwards. Once the card is full, the oldest clips are overwritten. On a busy van, that can happen quickly. That becomes a problem when a claim is made days or weeks later.<\/p>\n<p>Storage capacity is only part of the issue. <a href=\"https:\/\/ico.org.uk\/for-organisations\/advice-for-small-organisations\/cctv-and-dashcams\/dashcams-and-uk-gdpr-what-small-businesses-need-to-know\/\" target=\"_blank\" rel=\"noopener\">The ICO says<\/a> several weeks of routine footage may be longer than necessary, and footage should not be kept for longer than needed. The important part is being able to retrieve the right footage quickly. The business is responsible for how that footage is collected, stored and used.<\/p>\n<h3>Have a lawful basis and tell people about it<\/h3>\n<p>You need a lawful basis and a record of why you chose it. <a href=\"https:\/\/ico.org.uk\/for-organisations\/uk-gdpr-guidance-and-resources\/cctv-and-video-surveillance\/guidance-on-video-surveillance-including-cctv\/how-can-we-comply-with-the-data-protection-principles-when-using-surveillance-systems\/\" target=\"_blank\" rel=\"noopener\">Legitimate interests<\/a> may be appropriate for fleets using cameras for purposes such as claims defence and driver safety. Then tell people. A sticker on the vehicle can be enough for the public, pointing to a privacy notice setting out how footage is used and who sees it.<\/p>\n<h3>Do the impact assessment<\/h3>\n<p>If cameras are being used to monitor drivers, a <a href=\"https:\/\/ico.org.uk\/for-organisations\/uk-gdpr-guidance-and-resources\/employment\/monitoring-workers\/specific-data-protection-considerations-for-different-ways-or-methods-of-monitoring-workers\/\" target=\"_blank\" rel=\"noopener\">Data Protection Impact Assessment<\/a> is required. Write down what you record, why, who sees it, how long you keep it and what protects driver privacy. The ICO also <a href=\"https:\/\/ico.org.uk\/for-organisations\/uk-gdpr-guidance-and-resources\/accountability-and-governance\/data-protection-impact-assessments-dpias\/how-do-we-do-a-dpia\/\" target=\"_blank\" rel=\"noopener\">publishes guidance on completing a DPIA.<\/a><\/p>\n<h3>Get the driver side right<\/h3>\n<p>Drivers need to know before the cameras go live. If you later change the reason for recording, say from claims evidence to monitoring performance, update the policies and tell staff first. Audio should be off by default because it is intrusive and needs strong justification. Where vans are used privately, drivers should be able to switch the cameras off outside working hours.<\/p>\n<h3>Register and be ready for requests<\/h3>\n<p>A business running cameras in work vehicles <a href=\"https:\/\/ico.org.uk\/for-organisations\/advice-for-small-organisations\/cctv-and-dashcams\/dashcams-and-uk-gdpr-what-small-businesses-need-to-know\/\" target=\"_blank\" rel=\"noopener\">needs to register with the ICO and pay the data protection fee<\/a> unless an exemption applies. The <a href=\"https:\/\/ico.org.uk\/for-organisations\/data-protection-fee\/data-protection-fee\/\" target=\"_blank\" rel=\"noopener\">current fee<\/a> is \u00a352 a year for organisations with turnover of no more than \u00a3632,000 or no more than 10 staff, and \u00a378 for organisations with turnover of no more than \u00a336 million or no more than 250 staff.<\/p>\n<p>Anyone captured on camera can ask for a copy of footage featuring them, so somebody needs to recognise that request.<\/p>\n            <\/div>\n                    <\/div>\n    <\/div>\n<\/div><style>\n\t\/* Locked inline so the block stays white-on-gradient regardless of deploy state or\n\t   theme's global `p { color: text-secondary }` rule.
